Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the FlyGuys shuttle service and booking app (the “Service”), operated by FlyGuys (“FlyGuys”, “we”, “us” or “our”). By creating an account, booking a shuttle or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

FlyGuys provides vehicle and trailer shuttle services for river anglers and guides in and around Fernie, British Columbia. We relocate your vehicle, drift boat and trailer between river access points while you are on the water.

We operate our own service. You book directly with FlyGuys. Our drivers carry out each shuttle.

3. Eligibility and Accounts

You must be at least 19 years old to create an account or book a shuttle. You agree to provide accurate, current and complete information and to keep it updated. You are responsible for keeping your account credentials confidential and for all activity under your account.

4. Bookings and Payments

You book a shuttle in advance through the Service. Pricing is shown at the time of booking.

Payments are processed through Stripe, Inc. By booking a shuttle, you authorize FlyGuys and Stripe to charge your selected payment method for the shuttle fee plus any applicable taxes. A confirmed booking is a contract between you and FlyGuys.

5. SMS Messaging

By providing your mobile phone number and opting in during booking, you consent to receive transactional SMS messages from FlyGuys related to your booking. This includes booking confirmations, status updates, photo confirmations and communications from your driver. SMS messages are sent through our messaging provider, Klaviyo.

Message frequency varies based on your booking activity, typically a handful of messages per booking. Message and data rates may apply and are charged by your mobile carrier. FlyGuys is not responsible for these charges. Carriers such as Rogers, Bell and Telus are not liable for delayed or undelivered messages.

You may stop SMS messages at any time by replying STOP to any message you receive. After replying STOP you will receive a confirmation message and will not receive further SMS messages, though you may continue to receive transactional emails about your booking.

6. Vehicle Custody and Care

When you book a shuttle, you authorize FlyGuys to take custody of your keys and to operate and relocate your vehicle, drift boat and trailer between the access points you select.

We document each shuttle with photos and a checklist at pickup and drop off. We park your vehicle at the designated takeout and return your keys as instructed.

We take this responsibility seriously and operate with care. We do not guarantee timelines or outcomes. Conditions on the river, on access roads and at access points can change and are outside our control.

You are responsible for telling us about any condition, fault or restriction that affects how your vehicle or trailer should be driven, towed or parked. You confirm that you are the owner of the vehicle and trailer or that you are authorized to hand them over for shuttle.

7. Assumption of Risk

River activities, including paddling, floating, fishing and the movement of vehicles to and from access points, involve inherent risks. These risks include but are not limited to injury, vehicle damage, theft and loss of property.

You acknowledge and accept the inherent risks of your river activity. Access points are remote and unsupervised. FlyGuys does not control the condition or security of access points and is not responsible for events that occur outside our custody of your vehicle.

8. Insurance and Licensing

FlyGuys is in the process of obtaining the licences, permits and insurance required to operate a vehicle shuttle service in British Columbia. Coverage and responsibility depend on the facts of each incident and the terms of the applicable policy.

9. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Interfere with or disrupt the Service or our systems
  • Attempt to access accounts or data that do not belong to you
  • Submit false, misleading or fraudulent information
  • Hand over a vehicle or trailer you do not own or are not authorized to hand over

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error free.

11. Limitation of Liability

To the maximum extent permitted by law, FlyGuys is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms shall not exceed the greater of (a) the amount you paid FlyGuys for the shuttle giving rise to the claim, or (b) CAD $100.

12. Indemnification

You agree to indemnify and hold harmless FlyGuys, its officers, employees and affiliates from any claims, damages, liabilities and expenses, including reasonable legal fees, arising out of your use of the Service, your violation of these Terms or your violation of the rights of any third party.

13. Termination

We may suspend or terminate your account at any time, with or without notice, for any conduct we determine, in our sole discretion, to violate these Terms or to be harmful to other users, to us or to third parties. You may terminate your account at any time from account settings or by contacting us.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or by posting a notice on the Service. Continued use of the Service after a change constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the Province of British Columbia and the laws of Canada that apply there, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts of British Columbia, and you consent to the jurisdiction and venue of those courts.

16. Marketing Communications

If you opt in to our marketing list, for example through a signup offer on our website, you consent to receive marketing emails from FlyGuys. We send these through Klaviyo.
